Supreme Court Urges Mediation in Rs 30,000 Crore Kapur Family Inheritance Dispute
The Supreme Court has issued notice in the Rs 30,000 crore Kapur family inheritance dispute as Rani Kapur seeks asset protection against Priya Sachdeva Kapur. The court has urged mediation to resolve the high-stakes conflict involving the RK Family Trust and associated companies.
The Supreme Court on Monday issued notice on Rani Kapur’s petition against her daughter-in-law Priya Sachdeva Kapur and indicated that the matter would be heard on merits. However, the court strongly encouraged all parties to pursue mediation in view of the sensitive nature of the dispute and the advanced age of the petitioner.
A bench led by Justice J.B. Pardiwala expressed concern over the prolonged family conflict and emphasized the need for an amicable resolution. Addressing the parties, the bench remarked that continued litigation would be futile and urged them to resolve the matter comprehensively through mediation. The court observed that engaging in extended legal proceedings at this stage of life was not advisable and stressed that a peaceful settlement would serve the best interests of all involved.
The dispute stems from a suit filed by Rani Kapur challenging the creation of the Rani Kapur Family Trust. She has alleged that the trust was fraudulently constituted and used as a mechanism to divest her of her entire estate, including control over the Sona Group companies. The petitioner further argued that both movable and immovable assets are at risk of diversion, necessitating immediate judicial protection.
Taking note of these concerns, the Supreme Court also issued notice to several individuals, including the children of Bollywood actress Karishma Kapoor, Samaira and Kiaan, Mandira Kapur, and other associated parties. The bench acknowledged the possibility of the case evolving into prolonged litigation and reiterated the importance of mediation to prevent further escalation.
In her petition, Rani Kapur has sought multiple directions from the court. She has requested that Priya Sachdeva Kapur and her associates be restrained from dealing with or interfering in the assets, estate, and affairs of the RK Family Trust and certain closely held companies. She has also sought to prevent the distribution or utilization of funds, dividends, bonuses, and other financial benefits arising from these entities.
Additionally, the petition demands full disclosure of all assets and companies linked directly or indirectly to the trust, along with original documents related to its creation. Rani Kapur has also called for the production of minutes and resolutions of trustees since October 2017, as well as detailed financial statements of the trust and associated companies.
The plea before the Supreme Court follows Rani Kapur’s inability to secure interim relief from the High Court, where she has also sought the dissolution of the RK Family Trust.
The case now stands at a critical juncture, with the Supreme Court balancing the urgency of asset protection against the need for a conciliatory resolution. The outcome of the mediation efforts, if pursued, could determine the future course of one of the most high-profile family inheritance disputes in recent times.
