Centre Clarifies 40% Pension Commutation Rules: Key Changes, Medical Tests and 15-Year Restoration

The Centre has clarified pension commutation rules for government employees, addressing the 40% lump-sum withdrawal limit, medical examination requirements, application deadlines and eligibility conditions for employees facing pending proceedings.

The Central Government has issued fresh clarifications on pension commutation rules, bringing important updates for employees seeking a lump-sum payment at retirement. The Department of Pension and Pensioners’ Welfare (DoPPW) has recently issued four Office Memorandums (OMs) clarifying various aspects of the rules governing the advance withdrawal of up to 40% of pension.

However, the government has not changed the maximum pension commutation limit of 40% or the existing provision for restoring the commuted portion of pension after 15 years. The latest clarifications primarily address the application timeline, requirements for medical examinations and eligibility for pension commutation in cases involving pending departmental or judicial proceedings.

Pension commutation allows a retiring government employee to receive a portion of their pension as a lump-sum payment instead of receiving the entire amount through monthly pension payments. Under the Central Civil Services (Commutation of Pension) Rules, employees can commute a maximum of 40% of their pension. They can also choose to commute a smaller percentage, but the limit cannot be exceeded.

For example, if an employee's basic pension at retirement is Rs 50,000 per month and they choose to commute 40%, they will receive a lump-sum payment in exchange for the commuted portion, equivalent to Rs 20,000 of their monthly pension. Following commutation, their monthly pension will be reduced to Rs 30,000. The lump-sum amount is calculated using a predetermined formula.

The reduction in monthly pension due to commutation is not permanent. Under Rule 10-A, the commuted portion of the pension is restored after exactly 15 years. This period is calculated from the date on which the pension reduction actually begins, rather than from the employee's retirement date. Once the 15-year period is completed, the employee's basic pension is restored to Rs 50,000 in the example above, without any adjustment.

The government has also clarified the circumstances in which a medical examination is mandatory before pension commutation. Under Rule 18, employees retiring on invalid pension due to illness, those compulsorily retired as a penalty and those receiving compassionate allowance must undergo a medical examination before receiving the commuted pension amount.

Medical examination is also compulsory for employees who do not submit their pension commutation applications within one year of retirement.

At the same time, certain categories of employees are exempt from medical examinations. Employees retiring under the normal retirement process can commute up to 40% of their pension without undergoing a medical check-up. The exemption also applies to employees whose pension becomes payable following their absorption into a company or corporation or the abolition of their posts. However, they must submit their commutation application within one year of retirement to qualify for the exemption.

The latest clarification also addresses the position of employees facing departmental or judicial proceedings. Under Rule 8, employees against whom departmental or judicial proceedings are pending are entitled to provisional pension. However, the government has clarified that they cannot commute this provisional pension or receive an advance lump-sum payment against it until the proceedings are concluded.

Once the proceedings are completed and their pension is formally sanctioned, these employees can apply for pension commutation. If they submit their applications within one year of pension sanction, they will not be required to undergo a medical examination.

These clarifications provide greater clarity on the application process, medical examination requirements and restrictions applicable to employees facing pending proceedings, while retaining the existing 40% commutation ceiling and the 15-year pension restoration provision.
