Constitutional Clash: Rep. Randy Fine Proposes Ending Birthright Citizenship Amid Supreme Court Scrutiny

Rep. Randy Fine proposes a bold amendment to end birthright citizenship for children of undocumented immigrants, citing Pew report data. As the Supreme Court weighs Trump v. Barbara and Executive Order 14160, the legal battle over the 14th Amendment and the landmark Wong Kim Ark precedent reaches a fever pitch. A decision is expected this summer.

Florida Representative Randy Fine has announced plans for a legislative amendment aimed at ending birthright citizenship for the children of undocumented immigrants, a move that intensifies a national firestorm over constitutional interpretation and immigration policy. Fine argued that the current practice serves to reward illegal immigration, anchoring his position with a Pew report indicating that nearly one in ten U.S. births involve undocumented mothers. This legislative push coincides with a high-stakes legal battle currently unfolding at the highest level of the American judiciary.

On April 1, the Supreme Court heard oral arguments in the landUntitled design - 2026-04-23T130542.385mark case Trump v. Barbara, which challenges President Trump’s Executive Order 14160. The order seeks to strictly limit citizenship to children who have at least one parent who is either a U.S. citizen or a legal permanent resident. During the proceedings, the justices appeared skeptical of the administration's authority to bypass longstanding interpretations of the 14th Amendment. A final decision from the Court is expected by this summer.

The debate has been further amplified by President Trump via a Truth Social post, where he leveled sharp criticism against the ACLU and suggested the issue should be settled by a national vote. Conversely, opponents such as the ACLU have mounted a vigorous defense of the 14th Amendment, citing the 1898 United States v. Wong Kim Ark decision as the definitive legal affirmation of birthright citizenship. As the nation awaits the Supreme Court's ruling, the proposed amendment by Rep. Fine signals a burgeoning legislative effort to redefine the parameters of American identity and legal belonging.
