Life Imprisonment for Thane Man Who Stabbed Neighbor Over Harassment Dispute; Parents Acquitted
A Thane court has sentenced 42-year-old Mohammed Asgar to life imprisonment for the 2016 murder of his neighbor, Ahmad Raja Shaikh, in Mumbra. The fatal stabbing followed a dispute over the harassment of the victim's sister. While Asgar was found guilty under IPC Section 302, his parents were acquitted due to lack of evidence and witness inconsistencies, marking a major legal conclusion.
The conviction stems from a violent confrontation on May 21, 2016, in the Kausa area of Mumbra. According to additional public prosecutor V G Kadu, the conflict ignited when the victim, Ahmad Raja Shaikh, confronted Mohammed Asgar for allegedly harassing his sister and "peeping" into his house. The situation rapidly escalated from a verbal dispute into a physical scuffle. In a chilling display of aggression, Asgar rushed into his residence to retrieve a knife and proceeded to stab Shaikh multiple times. The assault occurred in front of several witnesses, leaving the victim with catastrophic injuries. Despite medical intervention at Sion Hospital, Ahmad Raja Shaikh succumbed to his wounds three days later.
In addition to the life sentence, the court imposed a fine of Rs 50,000 on the convict. The legal proceedings took a pivotal turn regarding the involvement of the accused's family. Judge Deshmukh observed that prosecution witnesses had made "improvements" in their statements by claiming that the parents had physically restrained the victim to facilitate the murder. These discrepancies created reasonable doubt regarding their participation, leading the court to hold that their involvement could not be conclusively proven. This ruling underscores the heavy reliance on consistent witness testimony in capital cases, ensuring that while the perpetrator of the stabbing is brought to justice, the shadow of doubt protects the co-accused from conviction.
