In a significant development, the Supreme Court on Monday refused to stay the Waqf (Amendment) Act, 2025 in its entirety, stating that no case had been made out for such a sweeping order, even as it noted that certain provisions may require interim protection.
During the hearing of the matter, the Supreme Court stayed the provision in the Waqf Amendment Act 2025 that a person should be a practitioner of Islam for 5 years to create a Waqf. The apex court said the provision stayed till the state governments frame rules on determining whether a person is a practitioner of Islam.
